- I would not agree with this interpretation f the Constitution - here is the 10th amendment which defines "ALL THE POWERS OF THE STATES.The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.To use the word NULLIFY is confusing some - If the Federal Legislature over steps it's powers and usurps then the States is within it's Constitutional duties to protect the people and their freedoms buy "REJECTION" [nullify] of the law as if were null void and never existed at all. WE must remember the first 10 amendments were caused by the ANTI - FEDERALISTS and made to protect the States and the people from tyranny and oppression like all suffered under the strong monarchy of the Kings.So, now we can then see, yes there is the intended power for the States to be more powerful than the Federal government when the Federal government reaches outside the ARTICLE I SECTION 8 enumerated powers. If the Founders did not intend this then why was it so stated - it would have no purpose and the States would have no remedy to protect the people from a new dictator. If the Federal government needs new power then it must go to the many state legislatures using ARTICLE V and create, debate and pass a new amendment.The difficulty of the Article V amendment process was intention on the part of the FOUNDERS/FRAMERS/RATIFIERS - they clearly desired to control the Federal government and limit it's powers over the States and the people. The Constitution was written in clear simple words or common usage and so all the citizens of that time period could read and understand the document and it's powers. WE have since tried to change the meanings of words, used introductory of general statements regarding the limits [enumerated powers].Again, the Founders created a timeless Constitution and intended it to be firm and and fair - not adjusted at the whims of a new group of politicians that usurp powers. If they did not intend for the Constitution to be timeless the would have added language that allowed changes in culture over the centuries; but no they knew that changes were not good and the states should be where changes in culture are exhibited. Therefore they gave us the Article V amendment process to make those changes that are required to adjust for time and needs. Thew proof that changes have occurred are the 27 times the Constitution has been amended.
